1.Charge for error messages sent by us to you as a result of any incorrect or incomplete details sent to us by you, which prevents us from delivering the requested service to you and for which we have to notify you of such non-delivery. Therefore you are advised to follow the instructions provided for downloads carefully
2.Deny access to all or any part of the services if the telephone calling line identification is blocked from the telephone line which you use to access the services
3.Close access to any features of the services if your use of that feature is deemed excessive (i.e. leaving large volumes of email on the central servers) and against the interests of other users of the services
4.Modify or discontinue, temporarily or permanently the services with or without notice to you
5.Suspend or deny access to all or any part of any e-mail or other communication address issued to you by us, web space or home page, at any time without notice if we believe or receive a complaint or are made aware of a complaint related to the content or use thereof
6.Reject your request for any personalisation of a mobile handset whether in whole or in part if such personalisation breaches or if we suspect such personalisation breaches any third party intellectual property rights
7.Communicate promotional offers to users of services on the Samsung Fun Club, from which the user may opt out at any time by SMSing OUT to 31107 (standard rates)
8.You confirm that we shall not be liable to you or any third party for any modification to or discontinuance of the Services.
9.We may change these Terms and Conditions from time to time. We will endeavour to notify you of any changes either by email or in a notice on our website. Your continued use of any of the Services thereafter, will constitute acceptance of such changes.
10.We reserve the right to terminate immediately without further notice your access to and use of the Services, if you do not accept any such changes.
11.Calls/downloads are charged at Value Added Service Rates. (Free minutes do not apply).
12.Premium rates are charged for content downloaded from WAP (including Vat) for Vodacom, Cell C or MTN, as stated on advertising material (for example, R5.00).
13.WAP access will be charged at your normal operator rate.
14.Errors are billed.
15.To download Polyphonics, Images, Realtones, Covertones and JAVA Games you must have WAP enabled.
16.Mobile Games :Refunds will not be given if you select content that is not compatible with your phone. Please be sure to check you are ordering the correct content for your phone before you buy and that your phone has Java if you wish to purchase Java games.
17.WAP is required: Refunds cannot be given if you purchased mobile content without first checking if your mobile phone has WAP functionality, has a data-enabled SIM card and has been configured correctly for use of WAP and data services.
18.Refunds cannot be given if you purchased mobile content and did not receive it as a result of your SMS inbox being full.
19.Artists names are used solely to indicate a ringtone, wallpaper or other content item, and are not indicative of any endorsement or sponsorship of the artists concerned
